I thought the issue meant children but in Re Kay's settlement the children couldn't enforce the contract and in Cannon v Hartley the children couldn't also. So who is the issue?

If you are aged 80 your children are probably in their 50s and your grandchildren in their 20s or 30s. But if you are 30 your children are probably aged well under 18.
