Possible case against home depot?

I purchased a full house of appliances the week of black friday. We closed on our home on the 7th and it was a new build and it didn t come with appliances. These appliances have been backordered 4 times already! My "next delivery" date is Feb 1st. They were originally supposed to be delivered the 8th of December, then the 26th of Dec, the 15th of Jan and now the 1st of Feb. What actions can I take if any? I have been working with home depot and GE and there is nothing that they can do. I m at a loss now because when we got them they were at such a great price. If I return them and get others I would have to spend 1000+ more and we just don t have that. Thoughts? Would this be something I can take to a lawyer?

Home Depot is getting worse and worse about losing deliveries or making them on time. This can be a major expense for home owners and should be considered in who to order them from.

Here is the problem and that you bought/ordered them with the Black Friday specials, which in many cases are in (limited) supply, thus many people lose out, since with limited supplies, can't get the specials. Now back in November, can see not concerned, since had not closed on the house thus, the delay on delivery was not a major concern.



But, with a new house and (no) appliances, then odds are that you was buying a refrigerator, stove, microwave and a dishwasher, or even a washer/dryer? But I can see (1) appliance being delayed or on back order, but all of them, then that does not make sense? Or, could it be that they have (some) but are holding off, due to the cost to deliver? In other words, many times if multiple items that are delivered separately, then can bill for (each) delivery?





Forget a lawyer, since YOU will be paying for the legal fees. Home Depot, even with a lawyer will (not) refund/reimburse you the cost of the lawyer.



Is there a Sears store near you? If so, then they have filed bankruptcy, thus maybe able to buy their appliances as a reduced costs, but can only buy (what) they have and there are (no) refunds.



Back in 1995, my (prior) house caught on fire, thus had to replace (every) appliance after being rebuilt. We went to HH Greggs which used to be the best appliance store out there, but is no longer there, since they filed bankruptcy a few years ago. But oddly back then, our house had and we bought all GE appliances and had no problems.



You (might) have to go to another store, like for instance Lowes or Menards as an example and pay more for the same appliances that they (may) have in store, or another brand vs GE. I would not pay more for other appliances at Home Depot, (unless) they are willing to give you a deal and if not, then by going to another store, might be willing or (not).



This is just a suggestion.

You could probably cancel the order. They either have the stuff or they don't, you can't force them to deliver stuff they don't have.

You have the legal right to cancel the order and receive a refund of anything you have already paid.

You also have the right to WAIT.

Those are the ONLY remotely viable options. The MOST an attorney can even theoretically do is force them to accept the first option.

if they never had them you can complain to the police for fraud or bait and switch which is illegal

The problem is if you don't get them and don't pay for them I don't see any actual damages. You'd need to show how you were damaged and what I'm seeing is a wash.



I'd complain long and publicly about it with as many photos of the promises and receipts as you can get.

Do you think a lawyer is going to work for you for free? You will spend more than the upgraded appliances are worth on an attorney.



- Talk to the store manager: a) complete refund of your price (go elsewhere, spend more); b) see if he/she can approve substitution of better models for same price (that are already in store stock), c) ask if they can check other HD stores in 200 mile radius to see if they have your models on hand and can ship intra-store, d) wait for your "great" deal to arrive.



- Talk to your state's department of commerce and consumer affairs if the manager will not resolve reasonably.



That's the problem with large box organizations. Lowes, HD, Costco - your best bet is to make sure they have several of what you want on hand, in store and ready to ship (at the advert price). IF not - you are better off looking elsewhere.

by the time you get a lawyer and start some kind of action your appliances will be there

if you’re working with GE, we assume the manufacturer, and still can’t get them sooner what is a lawyer going to do?

Will they let you order other appliances with similar discounts?? They should certainly give you something. Their Black Friday specials obviously weren’t even built and ready for the sale. They were just taking orders for the manufacturer. There is no such thing as customer service these days. Sad. Write the head of the company or contact a local TV station. Some have people who investigate these things.
