is there a 1st time offense pardon in the state of wisconsin? Or maybe someone can direct me to a site that will help me on the laws relating to this in the state of wisconsin

I don't think you can. Wisconsin has a strong open records law.

Wisconsin law allows a judge to "expunge" a case in only two situations, both involving youthful offenders:



Misdemeanors committed by a person under 21. If the judge ordered expunction upon successful completion of the sentence, the record can be expunged. See §973.015, Wis. Stats.

Adjudication of a juvenile delinquent. A juvenile who has been adjudged delinquent can, upon reaching age 17, petition the judge for expunction of the juvenile adjudication. See §938.355, Wis. Stats. .

I think the first offenders program only works if you get enrolled in it at the beginning. If you have not yet been convicted, have your attorney work on getting enrollment in the program as part of your deal. I'm not sure if first offenders is available for felonies, but I think it might be.



The county clerk of courts or the State CCAP system would be a couple of places to check.

You need to petition the court for an expungement. The seriousness of the crime and how long ago it was committed are key factors.
