Hello,

I have a question regarding Conflicts of Laws in Sexual Age of Consent matters.

I am a 17 year old girl from Delaware where I am allowed to have sex with someone up to 30 without them getting in trouble.

However, my boyfriend is 27 and lives in Philadelphia (Pa), where there is a corruption of minors statute (misdemeanor for sex between a minor under the age of 18 and a person above the age of 18). In this situation, which law applies? Does it matter if we have sex in Delaware or Philadelphia or does my valid consent in Delaware get voided as soon as I cross the Pa border?

The age of consent is highest of either where the act is committed OR the home state of minor. In other words he would be breaking the law if you had sex in PA.

In Pennsylvania the age of consent is 16. In Delaware the age of consent is 18, but a 16 or 17 year old can have consensual sex with someone under 30.

So it's not illegal.

Delaware age of consent is # 18 # You are a resident of Delaware NOT PA.

You can not break a law for a city if you are not in the city. It doesn't matter where he's from or lives. It's like the action isn't a crime where you are, so it doesn't exist as a law. Just make sure you're in Delaware when it happens and you'll be fine
