Do i have reason to sue a debt collector if hes refusing to take a derrogatory remark off my credit report?

My name was placed to a debt collector as the responsible party for a gym membership, i never signed nothing agreeing to have a membership, was never even there, and this whole confusion started becausw they asked my boyfriend if he wanted to put me on the membership he said sure thinking it was no extra cost I signed nothing now this debt collector is refusing to take this off my credit report and I can't get a loan to fix my vehicle (my transmission just blew) with that on there. He says he can help me pay it but hes not taking it off my credit report without contact from the gym. I have called the gym 20+ times, left endless messages, got a 30 min legal call that said i wasnt responsible since i signed nothing but this has been going on for 7 months and nothings being done, i dont want to be a jerk and get a attorney but i feel i have no choice, do you guys have any ideas?

So dispute it with the credit agency. The debt collector will have to verify the debt.

Yes, IF you can prove that that remake cost you money in the form of bad credit and higher interest rates.

Did you ever go to the gym and work out with your bf? Some gyms allow a one-time guest. Some, allow a guest more often. Some, perhaps, not at all. If you went to the gym and worked out, not as a guest, you may be responsible. Only a lawyer in your state would know your state laws concerning it and if there is no law about it in your state, the policy of the gym would be in effect. Sorry, I cannot say 100 percent for sure whether or not you are liable but, since they are holding you to it and are refusing to remove it, and you want to take out a loan, you should consider consulting a lawyer. For perhaps, a $250 consultation fee, you could end up getting your name removed from the liability or, you might know for sure whether you are liable. If you never went there to work out, and if your bf forged your name on the contract, then you would have to report him to the police and, if and when you are sued, down the road, you can sue your bf as a third party. If you haven't figured it out yet, break up with that bf. No decent guy would ever commit his gf to a contract.

Maybe your city has an "ombudsman". They're people trained to help resolve disputes. Try that before you roll out the big guns. . .

The debt collector does not have any authority to take something off your credit report.



Fill out a small claims lawsuit against the gym. As soon as you deliver it, they'll take the report off.

Tell the reporting agency about those creeps and they'll remove it.
