if i get forced to transfer from one department to another in walmart can the manager fire me if i say no?

i work in walmart pharmacy and the staff there causes nothing but drama and the manager is on her side and is always defending the girls and hes also the same ethic as them which is vietnamese and i'm not vietnamese but i'm another ethic but anywho if he wanted to transfer me out of the pharmacy department and i say no they should be transfer the other associate for their wrong actions because i been there longer can i get fired from him? what he did was he cut my hours on the new schedule after a meeting with the other associate, and if i get fired from the situation of not wanting to transfer department or locations am i able to collect unemployment? Thank you

If they have cut back your hours, that could be seen as being laid off. If the number of hours they're giving you is not sufficient enough for you to justify working there, you can give them notice and then claim unemployment.



That's not a hard and fast rule though. They will likely contest the unemployment and you'll have to appeal it. Then you'll have to be able to convince the unemployment office that what they were really trying to do was get rid of you by cutting back your hours.



If they only cut you from 30 back to 27 hrs per week, don't expect the unemployment office to be too sympathetic. But if they cut you from 40 down to 20, you should have a pretty good chance of wining your case.

What does your employment contract state about departmental transfers? If the contract says nothing or states that you must accept transfers, you can be legally fired for refusing the transfer. Such a firing would be for cause, and you could be denied unemployment benefits.

the boss will try and get you to quit because he can not fire you for something that dumb. unless it is your first 3months they need a valid reason to fire people. you have to live with them, after all is said and done. i would say make peace and if that is not an option. than find a new place and quit 1 day on the spot and make him find a new chump.

Any job that you can quit for any reason, or no reason at all, you can be fired from the same way. It is called "at will" employment.
