could some body explain the judicial branch in a few simple words.. because im not getting it.

what exactly do you mean, it is a very big topic. Basically it is the third branch of government, charged with taking the laws of Congress and applying them to the cases that come before them. then making a decision as to who, under the law, was in the right.

The judicial branch of government is established in Article III of the Constitution with the creation of the Supreme Court. This court is the highest court in the country and is empowered with the judicial powers of the government. There are lower Federal courts but they were not created by the Constitution. Rather, Congress deemed them necessary and established them using power granted from the Constitution. Courts decide arguments about the meaning of laws, how they are applied, and whether they break the rules of the Constitution. A court's authority to decide constitutionality is called judicial review.

The judicial branch acts as a check on the other two branches because it is the province of the judiciary to interpret the law, including the highest law of the land, the Constitution. The most important part of the concept of "judicial review" of legislation created by Congress and signed into law by the President is the ability of the judiciary to declare a statute "unconstitutional" and therefore render it void. Additionally, the judicial branch decides legal disputes, and not just those between private parties, but also disputes between private citizens and the government, and disputes between the executive branch and legislative branch. Through its judicial review of decisions of the executive branch and legislative branch, the judiciary acts as a check against the power of the other two branches.

the Judicial Branch applies the laws that the Legislature passes and the Executive signs into law. that is the ONLY function of the Judicial Branch
