I moved out of my home 7 weeks ago. I moved because the tenancy was finished.When i moved out the housing agency tried to withold
300 of my deposit. My friend who runs guest houses contacted the agency on my behalf explaining that they were breaking the law in doing so. The agency then contacted me and apologised for the misunderstanding promising that they would post the cheque to me. When i recieved the cheuque and banked it the angeny cancelled the cheque, they contacted me and said sorry we had to bounce the cheque, but we are now sending you out a replacement cheque. This cheque never arrived and it was only after Xmas that they finally admitted that they had changed their mind and were keeping the full £300 to cover a missing key.
The key had been returned to the other tenant as was agreed with the agency when i moved out. They are now denying this but it has been done and they have no proof otherwise.
Can you confirm that it was illegal for them to have bounced the cheque, and illegal for them to simply 'change their mind' after an agreement has been made? I thought a cheque was essentially a contract to pay that sum out?
Also for 5 months of my 6 month tenancy there was various problems with the house, in month 4 we were made aware that the problems were due to the electrics having been wired by someone who was not trained to do so, and therefore the house had no safety electric certificates? On my tenancy it said that if the house was inhabitable then a refund of some of the rent monies would be made.
Surely the lack of earth wires meant that it was illegal for the landlord to rent the house out, and the agency to have taken it on their books without doing a safety check?
Any advice would be much appreciated they have really been messing me around and been quite awful about the whole thing

As far as the cheque is concerned, as they agreed to return your £300 in full and in any event to withhold it because of a missing key would amount to a penalty rather than a reasonable sum to cover the landlord's loss in the matter, they have no right to keep messing you about in this way. Perhaps the time has come to get tough with them and threaten to take matters further unless they return your £300 forthwith. They won't like the idea of the Health and Safety authorities sniffing about the premises.

write to the agency,saying that after taking legal advice,they have 14 days to return your deposit and if they do not you shall be taking them to the small claims court and any cost,s incurred by this action will be added to the amount,.and that you are sure that they don,t want to go down this route as it will give them bad publicity,if they do not pay,see your citizen,s advice office.Small claims courts are not to expensive and if won,which i am sure you will,you can claim expenses on top.

tell them you are going to the police.

you are going to report them for stealing your money (theft)

you are going to report them for fraud and deception for issuing and bouncing a cheque etc and they have 24 hours to do this or you are going to the police station.

what they have done in all is illegal
