300 of my deposit. My friend who runs guest houses contacted the agency on my behalf explaining that they were breaking the law in doing so. The agency then contacted me and apologised for the misunderstanding promising that they would post the cheque to me. When i recieved the cheuque and banked it the angeny cancelled the cheque, they contacted me and said sorry we had to bounce the cheque, but we are now sending you out a replacement cheque. This cheque never arrived and it was only after Xmas that they finally admitted that they had changed their mind and were keeping the full £300 to cover a missing key.
The key had been returned to the other tenant as was agreed with the agency when i moved out. They are now denying this but it has been done and they have no proof otherwise.
Can you confirm that it was illegal for them to have bounced the cheque, and illegal for them to simply 'change their mind' after an agreement has been made? I thought a cheque was essentially a contract to pay that sum out?
Also for 5 months of my 6 month tenancy there was various problems with the house, in month 4 we were made aware that the problems were due to the electrics having been wired by someone who was not trained to do so, and therefore the house had no safety electric certificates? On my tenancy it said that if the house was inhabitable then a refund of some of the rent monies would be made.
Surely the lack of earth wires meant that it was illegal for the landlord to rent the house out, and the agency to have taken it on their books without doing a safety check?
Any advice would be much appreciated they have really been messing me around and been quite awful about the whole thing
