How can i take away my ex husbands rights of my children?

My ex husband is currently in prison for sexual assault of a child. His arrest title is SEX ASLT CHILD/14-17 . He is supposed to be released Nov 24th, of 2010, and I would like to make it so the children are safe from him by the time he gets out. Or at least get the process started. He had two arrests previously for theft, and each time he got out of jail he was out for 3 months. This is not a life i want my children to have. They have a stable life with me and my fiance, and that is how i want it to stay. (he is a Texas state trooper) I have looked all over the internet for the paper work i need in order to file. I have already found different documentation stating how he should lose his rights because of this offense.

I do have a question for you. When your ex was convicted, what exactly was his sentence? Did they say anything about him having to register as a sex offender? And did they say anything about him not being able to be around anyone under the age of 18? Those questions are very important and you need to learn all the details as they can help you take your ex's rights to the children away.



Anyway, don't try and do this yourself. Instead, hire yourself a good lawyer and go to family court to have him stripped of his rights. Be prepared to show proof that your ex was convicted of sexual assault of a child and that he is a habitual criminal. Good luck.

Courts are reluctant to take away a parents rights completely. You sound like you have a good case, but you really need a lawyer on this one.



You file for full custody without visitation rights.



You could have your fiance adopt the child.

File for full custody. No judge in their right mind would give someone who has a child asaullt charge against them the right to visitation or anything, and to seal the deal I would consider a restraining order too.

consult a lawyer and see what your legal right are in this kind of situation..make sure you have full custody of them and that there is a order of protection against him, so that they cannot see him after he gets out. Most states have laws with sex offenders, that they are registered and not allowed to be around children.

You would have to check with a lawyer and it would have to go through the courts. It will be a battle.
