****************What exactly happened in 1947*****************

Jammu & Kashmir in the year 1947 was an independent country for all practical purposes. The *Maharaja who ruled the State had signed agreements with both Pakistan and India to remain neutral and not be part of either country. India honoured that agreement but Pakistan did not. Pakistani raiders and soldiers attacked the state in 1947 forcing the Maharaja to flee to India. The Maharaja asked India to help his people who were being killed and looted by the Pakistani raiders. **He also agreed to make Jammu &; Kashmir part of India. **The Indian ruler at that time was Prime Minister Jawaharlal Nehru. *He accepted Jammu &; Kashmir's accession to India and agreed to rescue his people from the Pakistani attackers. Indian troops were flown into the Kashmir Valley and they managed to drive away most of the Pakistani raiders from the state. But a large area of the state remained under the control of Pakistani soldiers. These areas were difficult to reach because they were surrounded by tall mountain ranges. Also, India wanted to stop the fighting. The fighting ended with Pakistan retaining control of a large area of the state but India keeping a larger part.

Legally, Jammu & Kashmir is an integral and inseparable part of India.



Northern Kashmir is shown cut off from the state and the territory forming part of Pakistan and China. In the 1962 war, China illegally occupied "Aksai Chin", the land rightfully belonging to India. Here CIA has referred to it as 'Indian claim'. (CIA- central intelligence agency)

Northern Kashmir is termed as *"Pakistani Kashmir"*. This land is well-knowned as Pakistan Occupied Kashmir (POK). But has called it as "Pakistani" ie. belonging to Pakistan.



Legally complete Jammu and Kashmir State belongs to India. & is silent about China occupied Kashmir.



**conclusion: J& k is part of india legally .bcoz mahhraja agreed to give it to india.

but pak has occupied a portion in north.

Jammu and Kashmir is definitely part of India. Maharaja Hari Singh signed the Instrument of Accession into India. Pashtun tribesman illegally attacked Kashmir with the help of Pakistani soldiers. Also a referendum was taken in Indian Kashmir on joining Pakistan. Only 2% wished to join. However Pakistan claims that people in Indian Kashmir are waiting to be "liberated" by the Pakistani Army. Stupid UN just ignored IA and made 1/4 Pakistani and 3/4 Indian. And now China has jumped in claiming the Aksai Chin and Trans-Karakorum as part of Tibet Autonomous Region. But Kashmir should always remain part of India.

Jammu Kashmir is not part of INDIA, it is a disputed territory, to all the reader here, most of the answers are made by biased Indians. KASHMIR wants independence they dont want to be part of India or Pakistan, yet the Pakistani controlled Kashmir are quite happy with being part of Pakistan. Each and every state has the right to choose if they want to be independent or part of a union. Kashmir has made a choice to become and independent country, The indian military is killing anyone who is a supporter of the independence movement. Basically the Indians will kill every last kashmiri but they will not give kashmir away without a fight, this might lead to the destruction of India like we witnessed in the Balkans and the collapse of the soviet union

The State of Jammu and kashmir holds a special status under the Indian Constritution.

This is enshrined in Article 371 of the Indian Constitution.

Kashmir gets special status and the rules which apply to the majority of Indian citizens are not applicable to kashmir.

U have to ask the appropriate State goverment authorities regarding the rules as regulations for Investment/Business in Kashmir even if you are an Indian citizen.

Kashmir is disputed by Pakistan and due to this condition,even today we have the kashmir problem.

1/3rd of Kashmir remains under Pakistani occupation since the war in 1947.

Constitutionally J&K is an integral part of India.

yes , jammu & kashmir are very much within the indian territory . but when the people of jammu and kashmir don't think that they belong to india , then what is the indian government supposed to do ?.

suppose , you being an indian would prefer living in pakistan , then i don't think any one can stop you legally , right ???

the innocent people of jammu & kashmir have been provoked by pakistan and their ears have been poisoned against india , so they have turned rebels .

jammu and kashmir belong to india .

it is the crown of india and though the people of jammu and kashmir may not follow the indian governments rules and regulation , we can't afford to give jammu & kashmir to pakistan .

if they want jammu & kashmir then let's take the whole of pakistan in exchange of jammu & kashmir .

Jammu & Kashmir is a state of the Indian republic...

Some states and union territories have some additional provisions in the provincial laws... Such provisions were included at the time of taking over the area from the erstwhile kings / rulers after India got independence from the British Raj...

why doubt? J&K is a part of India. the instrument of accession of Kashmir has granted certain autonomus status to the state of jammu & Kashmir. these autonomous rights were promised by india while J&K joined with india

the Jammu and kashmire is not part of Indian or Pakistan,or china .The Jammu and Kashmir is spread over an area of 222236 square kilometers. Jammu and Kashmir is bordered in north by China, east by autonomous region of Tibet, south by Indian states of Himachal Pradesh and Punjab, and west by Pakistani city of Rawalpindi and Frontier Province and on North Western side by Afghanistan.



The jammu and Kashmir was bifurcated in two parts during 1947 and then again a large chunk of the land was severed during 1965 Indo-China war. The J and k consists of three parts Indian controlled Kashmir (IcK), Pakistan controlled Kashmir (PcK) and China controlled Kashmir (CcK). The Pakistan administration first bifurcated PcK into Azad (Free) Kashmir (AK) and Northern Areas (NA) and then again it donated a large chunk of land (Shaksam valley of 5180 sq km) to China during its border agreement of 1963. But according to the signed document, this Sino-Pak agreement ceding a part of Kashmir is provisional and that it will be renegotiated with China after the Kashmir dispute is settled.



In order of percentage, 48 per cent of the territory is under Indian occupation, 35 per cent is under Pakistan and rest 17 per cent is under control of China.



Total Area of Kashmir: 222236 square kilometers



India Controlled Kashmir: 106,567 sq.kms



Pakistan Controlled Kashmir: 78,114

J & K is an integral part of India. It has some special laws applicable to J & K only which are per agreement between Govt. of India and Maharajah of Kashmir when he conceded to India.

Pakistani politics. Is the only cause of violent of Kashmir , Pakistan politicians invoke innocent man of Kashmir like Burhan Wani to pick up the Gun against its own government , there were. 13 FIR registered against him , now when Police ask him to surrender he never did , unfortunately he was killed by cross encounter . In the name of Islam Pakistan want to separate the land. From India because when Pakistan attacked India they could not suceede to capture it , because it is an Indian land but still it captured half of the Kashmir known as Pakistan occupied Kashmir where Pakistani atrocities is also present . Since India never force back to capture its land therefore. It is fully controlled by Pakistan , now Pakistan planning to take remaining Kashmir or separate it since they could not capture it by meaning of proxy war like training young men to pick up the guns , in the name of Islam , I could not understand why people of Kashmir do not understand it .

India's Muslim population is almost equal to that of Pakistan. As per your criterion all of them should be in Pakistan. Why it hasn't happened please tell me. Why are you so selective about Kashmir state that has acceded to join Indian Union, part of which has been taken over by force (& also a quarter of it is in the possession of China). Let me tell you one thing. This problem will never be solved.

it has a special status in indian law which gives this state a significant place. it is due to the misconception of first indian primeminister who himself was kashmiri and had a soft corner for J&K.
