How do I get my back payment that I was supposed to get from Social Security that my mother took?

I was under 18 at the time, and from the time she applied for social security for me, till the time I was approved was YEARS, at least 5 years. I'm 28 years old now.

I need that money now. She told me she needed the money for the double wide house she and her new husband is living in, and they both are on Social Security now, ...

Is it possible to get that money from her, or part of it, because I'm sure it's very large check, enough to put a down payment on that house they are living in now.

She said, I should have that check because of taking care of me all those years.

What can I do?

is it right for her and her husband to take that money?

I don't think it was right for them to take that check, but five years later there's no way you're going to be able to do anything to take it back.



By the way, it's not a double-wide house. It's a trailer.

If the payments were Social Security, I assume you were eligible for a survivor's benefit from your father. Survivor's benefits would be paid to your mother from the time of your parent's death up until your 18th birthday, or 19th if still in high school. Your mother could use the money to provide for you.



If she provided for you and then received retroactive payments, she could consider that reimbursement. She doesn't have to give the money over to you, just as she would not have had to save the money for your future benefit.



You can check with the SSA to see what benefit was paid to you. I bet it is much smaller than you think.



But sorry, no, you cannot recover either survivor benefits or supplemental security income payments made for you to your mother for a period when you were a minor.

The social security benefit received on behalf of someone under 18 is provided to the parent/guardian for the minors care, ie, food, housing etc. Your mom provided a place for you to stay and kept you fed. You cannot get the money back claiming the money was misspent. It was not your money but money to take care of you. There is nothing you can do now to reclaim the money spent prior to you becoming an adult.

Nothing you can do. If you were under 18,the money goes to her,not to you. If you were entitled to any of the money after you were 18,SS would have sent you your own check.

The check was not intended for your personal use. SS pays your mother for your food, housing, clothing..etc. You are in no way entitled to that money now.

The only way I know was to file a police report stating the check was stolen. The investigation would have exposed the person that cashed the check. If that person was not you, SS could re-issue the check since the 1st one was stolen. It may be too late now.

the s.s. check was not intended for you personally, it was for your maintenance during your minor years. my minor daughter ( 17 ) receives $951.00 per month that's paid to me for her upkeep/expenses/maintenance. i usually give her 1/2 and i use the other half for food/rent/utilities. you can't get it back. i can tell you it doesn't take anywhere near 5 years to receive s.s., more like 30-60 days.

You could report her to SS and they could charge her with fraud. Do you think she has the money to repay you or would you like to have her go to prison?
