Laywer calling my work for old debt?

I have an outstanding Visa bill that has been trough collections and a lawyer contacted me today. Said they are taking action.
I, first, told her not to call my work again and provided her with my cell phone number. I then told her I was going to file bankruptcy. She wanted to speak with my manager and I refused, I told her I was going to speak to my own laywer and hung up.
She called RIGHT back she said she doesn't hve time for me to go bankrupt and said she would keep calling.
I hung up on her again, she has not called back. But she will tomorrow I'm sure.
I'm in ontario, canada and I need to my legal rights. Can she speak with my manager? Doesn't she have to send stuff throuhg the mail first, I have yet to receive anything from a lawyer.

When you file for bankruptcy, your trustee will contact your creditors and all action will stop.



If she calls you at work again, give her the name of your lawyer/trustee. Also, ask this "lawyer" for their full name and Canadian Bar Association number. This doesn't sound like a Lawyer to me - they are not allowed to speak to your manager, or tell you that bankruptcy was not something you could do. Look up this "lawyer" on the law society website in your province to verify if she is actually a lawyer. If she is, call the law society immediately and file a formal complaint. All complaints are taken seriously. If she is not a Lawyer, the law society will go after her for pretending to be one - the collection agency could be nailed too.

Well, in the US once you tell them not to call you at work, legally they are NOT allowed to contact you there any longer. They are also not legally allowed to speak to your manager. It's called the privacy act. If you are filing bankruptcy, all you should have to do is tell them that, give them the name and phone number of your lawyer, and they should NO LONGER contact you. It should all be done through your attorney. If they won't take the information, you should get the persons name to whom you are speaking with, their managers name, the name of the company and their phone number, then give all that information to your attorney and have your attorney contact THEM. If it was really an attorney contacting you, then yes, the normal procedure would be for them to send you a letter through the mail. It sounds more like a collector trying to 'scare and harass' you and maybe even trying to threaten you, Which, by the way, they are NOT legally allowed to do. You could sue THEM for that,( but you have to have proof, like recorded phone conversations.)

The Fair Debt Collections Act covers the US, Canada, Puerto Rico, Guam, and a few other territories. It says they can't call you at work, can't call your employer, can't threaten you, can't call after 6pm (or 9pm in some states), and a few other terms.



Tell her if she calls you at work again, you will be filing suit against her for violating the Fair Debt Collections Act.

First of all they can't call your work, you can get them for phone harrassment. Second of all they can only call you up to 9pm NO later. She can't speak to your manager anyways, so tell them to go and fly a kite. I would contact a lawyer and see what she/he says. They shouldn't be calling your work what so ever. Good Luck!!!

One thing is your job relationship, and another the status of your debts... but now she knows that you are nervous about it... you could talk with your manager and tell what they pretend doing it... if you manager is a comprehensive boss, just has to say it's not my business and goodbye
