Basically I'm on probation and the papers that my P.O. gave me it says that I need to remain drug and alcohol free but I'm confused because it says TBD (To be determined) for "reporting frequency" and it also says TBD for "urinalysis testing." It also says on the paper "schedule your drug and alcohol evaluation by TBD." Can someone please clarify this for me. We scheduled our next appointment for December 1st. I did smoke, so I'm kind of worried. Someone told me not to worry because they were once on probation for the same thing and to make a long story short, he told me give you 3 warnings, but I'm still a little worried.

Yes you can. The form with the TBD allows the probation office to determine when, and if testing is necessary and evaluated by who ever they choose. People get their probation revoked all the time for breaking the rules about getting high of drunk during probation. Don't be an idiot and get tossed in jail for it. They may be more lenient on you if you have also been ordered to attend NA or AA meetings because the court would be aware of an addiction, but you can't just get high, and then claim you had been going. You would need to show proof and only those court ordered bother to get forms signed proving their attendance.

TBD just means To Be Determined. It means there is not a set date and they can test you at any time

It's all up to the judge if they want to give you a warning or not. It's not a law to give you a warning. The judge can send you to jail if you test positive if they want to. That's the judge's decision and how much of an example they want to make of you.

You have 3 weeks. Start going to Marijuana Anonymous meetings ASAP and go regularly. When you get to court you can say you are an addict, you messed up, but you are now going to meetings and have a sponsor and want to get over this. That will show that you accept you have a problem but are trying to overcome it. Judges are less likely to jail you if you are going to meetings and showing that you are trying to get off marijuana



Seriously why would you risk it when on probation? You can't go 3-4 weeks without smoking?

Of course you can. TBD means to be determined. Simply means they are not yet scheduled but they will be. Time to put away the pipe for a while.
