Question:
Will I have a case and win? If so, how much can I make?...I started as a dishwasher and wore latex gloves.?

My hands would always be in water and I’m constantly changing gloves.Soon, I’d notice every night I go home my hands would be cracked and burn. So I would assume its just the fact that I’m working with water.I was moved up to cook. In about a few weeks my hand would itch.I didn’t know what it could be. Every time I itch, overnight, I would loose pigment on one of my hand, once I noticed that my right hand was loosing pigment, common sense told me not to itch the other hand. I would tell the staff the issue but all their opinions did not work. Continually I kept itching and gradually lost pigment. Its until one day I was talking to my medical teacher in h/s and she asked about my hand n told her the story. She felt disgusted and wrote me an ointment that might help n gave me non latex gloves she had in a cabinet. The ointment didn’t do nothing at all but the gloves felt better. They waited long before they decided to get non latex gloves. owner said u dnt really need workers comp.

You have no cause to sue. You didn't even go to the doctor. If you did sue you would have to do so under workman's comp laws and since you didn't lose any work time, you would get nothing.

I'm afraid the owner is right. They owed you a duty of care as your employers. They provided you with latex gloves and it seems you have some sort of allergy to the gloves. The duty of care was not breached though. It's not as if there was some type of chemical in the water to cause your irritation.

Further, you only receive compensation when you have suffered a loss as a direct cause of the employer's breach. Had you had to quit your job as it was too severe to work you, or had serious medical reprecussions, this would suggest a loss. In your case there is no actual loss so even if you were entitled to compensation, you would receive a very small amount, if not nothing at all.

No, you have no case and will not win. You do, however, have a latex allergy along with millions of other people! It is not the fault of your employer that you are allergic to latex! If you knew of your allergy and your employer put a gun to your head and forced you to wear latex gloves or suffer the consequences, yeah, I'd say you've got a case. Why do people like you expect medical professionals and employers to know something about your body if even you don't?

You won't make anything. You do not have a case. You didn't suffer an injury that would prevent you from working. You are allergic to latex. While your employer should provide you with the proper equipment,if you were aware of the allergy,you could have provided your own gloves while waiting for the employer to purchase them.

Your hands were either extremly dry, or you are allergic to latex. A latex allergy is not cause for a workers comp claim. However, you do need to see a doc. Allergies get worse with repeated exposure. You need to get tested to see if it really is allergies, get medication to take in case you do come into contact and react, and start using non latex.

You CAN get workers comp if you were injured while doing your job. But as for suing, you probably won't win and you'll just end up with a bunch of lawyer fees.
