Novelty ID's legal or illegal?

So my brother is 19 now and lives in montreal. A few weeks ago he bought a "novelty" id card so when he comes back to the states he can buy beer and other stuff. He was talking about this earlier and my grandpa and him were fighting on who was right, is the id legal or illegal?

Using a novelty or fake ID with the intent to purchase alcohol in the United States is illegal.

Novelty IDs are just that, "a novelty". As long as you do not use them to defraud or commit identity fraud you are fine. If you use them for anything other than a novelty, you are commiting a crime and can be prosecuted to the fullest extent of the law. People get these novelty IDs including novelty passports for non existing countries, BUT they do not use them to open bank accounts, get any government aid or services.

If it is made to look identical to any official State ID, then it is illegal. A "Novelty" would never be mistaken as true identity.



Also, the legal age in the states is 21 anyway. (Not sure if there are any states that differ from that)

It is illegal to make any ID that looks like or is similiar to ID's that are currently in circulation such as drivers licenses, state ID cards, medical insurance cards etc.

to buy a novelty ID is legal itself but to use it to buy beer underage is very illegal and he could be in big trouble

It depends on how you use it. The card itself is legal.

It illegal if he tries to use it, otherwise nothing is stopping him from having it.
