The legal system does allow some 10 year old offenders to be tried as an adult, but it's not very common. A 16 year old accused of a particular heinous crime is far more likely to lose 'youthful offender' status.



The 10 year old would most likely be charged with the lowest level of homicide applicable to the circumstances. This might mean involuntary manslaughter instead of second degree murder, especially if the death was an indirect result of another crime. A defense attorney might work out an acceptable plea bargain with the district attorney, and the child may only serve a few years in juvenile detention. If the case goes to trial, the law does not allow for a life sentence or death penalty for youthful offenders. The child might be under state control until he or she reaches adult age, then the records could be sealed and the child released under strict probation terms.



It would be very unlikely that a ten year old would be given a death sentence, because society in general favors the opportunity for a child to reform him or herself.

A 10-year-old cannot recieve the death penalty in the United States. Until recently, the United States was the only developed nation to execute minors, but no states allowed the execution of children under the age of 16 (and as I remember, Texas was the only state to execute someone for a crime committed before their 18th birthday).



The age to be tried as an adult ranges from 10 to 14 (or maybe 16, I can't remember), so in some states the child could be tried as an adult and sentanced to life in prison. However, regardless of the minimum age allowed, it is unlikely that a child under 14 would be tried as an adult. Most likely he would be sent to a juvenile correctional facility until the age of 18.

It depends on what type of murder it is. In some cases the kids are tried as adults. Other cases the kid will just go to juvie.

...As for the boy [who, in the eyes of the Law, is a 'minor'], he will be sent to a 'reformatory' or 'borstal' [British term] school - which should, hopefully, correct his attitude, and transform him into a useful adult and good citizen, by the time he is set free.
