Question:
Can employer skip a check?
2007-06-07 09:16:20 UTC
I am paid weekly for example June 1-7 is the pay period and get the check for that on the 8th. My employer (for which there is only 3 employees) is wanting to skip that check, and pay it to us on the 15th. In turn, being a "held" delayed check. Can they do this, and make us skip a check?

Time you started looking for new job as this one is bound to be over soon when employer starts running out of payroll

it is time to fly

Yes they can, but it is a very bad sign

Sorry Check with employment office for options on how to deal with it

Start unemployment claim now while still working get week waiting period over now

Yes, the law actually says that employees paid weekly have to be paid within 10 days of the last day of the pay period. Thats why most people have to wait two weeks to get the first check, but get one a week after they leave a job. The employer gets to leave it in thier account and collect interest for an extra seven days...

The only check that can be held back is ur first one. For example: if u start after the pay period starts. All others must be paid on time.

Well, I used to work for a University whose printers would always go down on payday. They did this to let the money sit in the bank for another couple days to collect the interest. So, yes they can, if they still pay you the wage they told you they would. They have to make it up on the next check, they can't just not pay their employees for a pay period. This is why i do corporate America, small businesses have more problems.

For holidays an employer can skip a day. But otherwise no they need to pay the same time every month. You tell the employer that you need every pay check to pay your bills on time and that you need at least half a pay check on your normal pay day.

they can hold back a weeks paycheck the first week as a final check. what they will do is on the 15th they will pay you for the 1-7th period and continue moving the check back so that your final check comes the week after you resign.

No. He's responsible for paying you for hours worked. Contact Wage and hour board/State labor relations.

Only your first check, if he has paid you before, then he has to pay.
