How can I take this case to court? What court would be most appropriate?

My husband and I signed on to a marina boat slip waiting list 2 long years ago and have been waiting to be called to be told that a slip is available. We checked the other day and noticed we'd been dropped from the list. When we inquired about it, we were told that a letter was sent out that was meant to update the waiting list. Waiting list people were supposed to fill it out and return it if they wanted to stay on the list or they'd be dropped. We never received the letter. They dropped us from the list and now, after we've explained the whole thing rationally to the Property Owners Association, they will not re-instate us to where we were before. Now, we face waiting another 2 years for the slip and this is unacceptable.
We intend to go to the board of directors for the POA but, if they do not reinstate us, would we go to small claims court or another court to see about righting this wrong? Please let me know! Thanks in advance.....

they did nothing wrong, they said they sent out a letter for the people to update the waiting list, yours obviously got either lost or you did get it and possibly threw it away. no matter what the reason is, they said they sent it and you cant prove otherwise in court. besides, what would you sue for? is this costing you money? if not, then there is absolutely nothing you can sue for, only time has been lost and they would probably win the case.

The best and probably only court available: The court of public opinion. Maybe some pressure of bad publicity is what's called for here. You could also not let the issue drop...and maybe they'll reinstate you just to get them off their back. Whatever you do, step back for a moment and determine how important this issue is to you...then apply that level of passion. Good luck.

You'll lose...there is no requirement for the marina to even have a waiting list. Unless you can prove they dropped you due to you belonging to a protected class, they can pretty much do anything they want.
