What can i do legally if anything about me getting fired for my performance at work. Im currently 4months pregnant, n just started working here at a clothing store (would that be bad, in any case) . I tried my best to carry as many go backs as i could, n when i couldnt id try to do anything else i could clean hang ext... I also have anemia and they know this... Today they let me go cuz "im slow" and even tho the manager ask for them to put me on the register that week, the head cashier refused... "anyone can do that" is what she said.

i dont see how being 4 months pregnant would effect your work performance but at any rate:



they didnt fire you BECAUSE you are pregnant.... they fired you because you were slow. which they actually have a right to do so.



if your anemia is causing you to have some sort of "disability" then they should have given you "reasonable accommodations" but seems as if you never asked for such accommodations..... in this case, you are out of luck....





sorry but you have no legal recourse over this.

4months along is not an excuse for poor performance unless you are a stripper. Nor is anemia since you took the job with it and must have expected that you could perform the work then.



Bottom line, you have an at will job unless you are in Montana (different laws) and they can fire you or let you go without cause. They have done that.

You would have to be able to prove that you were actually fired for being pregnant and not for poor performance as they state and if you cant prove that, then you dont have a legal leg to stand on here, so make sure what you have is strong enough to stand in court or teh Judge will toss it. Try for Unemployment here and see what they find out as the reason for the termination and go from there. Good luck

Your productivity shouldn't be affected at 4 months.
