I have a overpayment for like $7,000.00 BUT its not my fault. I was a minor and I had a rep payee which was my mother and now SSI is telling me I have to pay it ALL back! What happened was she was working and NOT reporting her wages!! I have tried to explane this to them, I have also filled out for a reconsideration and I wanted to have a informal conference but I was also denied that as well. I was sent a notice on Saturday saying that it was denied I can go to the ALJ, but I didnt even get a fair review befor so what can I do? Also it does state that I wasnt at fault for not reporting the wages but the money was used for my needs, but I didnt even get a chance to show I cant afford to pay the money back because I wasnt at fault? The person who decided my case I feel like she mislead me because she had me bring down all this info and she told me she was gonna help me and then she just made everything worse!! I cant afford a lawyer because I am on a buget I have 2 small kids and this is the only income I get! I am at my last ends I feel as if she KNEW she was going to denie me as soon as she got my case, from the 1st time we spoke she has done everything to down talk me and insult me. She said it's me who has to pay this back and I feel like it's unfair I am like really really strapped for money anything I get goes in 1 hand and out the other! So if anyone knows anything that can help or anyone to help me for free (because I can't afford to pay) please let me know, I live in northeast pa. Also if anyone know where and how to complane about this person please let me know. Thankyou

You will want do search for legal aid services in your state.

Did the person helping you tell you this:



If you agree that you have been overpaid but you feel you should not have to pay it back because you did not cause the overpayment and you cannot afford to refund it or repaying it would be unfair, you should file the form SSA-632-BK, Request for Waiver of Overpayment Recovery Or Change In Repayment Rate.

If your mother received the benefits on your behalf the she is responsible.

Take it to court, you were a minor, you cannot be held accountable.
