If someone trademarks a phrase (words only, no specific font) can I....?

re-do the phrase (to look more like a logo), add a graphic and trademark that? For example, if someone trademarks "Let's Roll", just the words (and no, that's not the phrase I actually want to use) can I make that into two rows of fat, bubble-type letters with a plane in the background and trademark that specific design to sell on shirts or what have you? Any insight is appreciated.

There isn't a simple answer to the question, based on the information you gave.



Trademarks aren't usually issued for phrases alone - they're more commonly issued in specific international classes with regard to specific types of products - using your example, Let's Roll might be trademarked in connection with Bread and Rolls... but might be available for tires.



Determining the precise application of the rules to any specific proposed mark is one of the biggest parts of a trademark attorney's activities...and isn't recommended as a home sport. The risk is more than just the USPTO application fee - it's the six month to one year that you fight what can be a losing battle to get your mark registered.

Darn, I can not remember of the boxing announcers name

that copyrighted the



"LLLLLLETS GET READY TO RUMBLE" phrase, so I think

that if you want just words it would be a copyright, if you wish

to include the bubbles you can register that as a trademark

back whilst i grow to be in 6th form(polytechnic), i had one. i used to declare this french sentence; "je suis le chef". meaning i'm the boss. i got here up with that. yet I have no trademark anymore.

i think anyone who trademarks a phrase is stupid if i want to use that "phrase" im going to i dont care what anyone says FREEDOM OF SPEECH BABY! LOL HAHA
