I do think the narrowness of the ruling was suitable for the case, and serves a purpose: a later test case, which might even affirm the view Thomas expressed in this one, can only clearly do so if the factor of regulatory hostility toward the religion is absent.



I might have to go look at Thomas' full opinion before I'm sure whether I agree or not. He IS on record as holding the view that the Establishment clause restricts only federal government, not states. I believe on that he is mistaken, and I would have to consider whether it (combined with his known preference in religious establishments) has affected this opinion.



Besides, Thomas' view on the Establishment clause would undermine Kennedy's basis for the ruling, by allowing a state to establish in law either (as Thomas would prefer) some form of Christianity, or (as the Colorado commission demonstrated) hostility toward Christianity.

I disagree that he was allowed the right to refuse service to the gay men. Who is next those who are not virgins, those who were divorced, those who are rich (there are 3-4 times as many verses about rich sin). Does he discriminate against those who do not observe the sabbath? How about those who are not Christian and of his beliefs? If you are in business and open to the general public, you have a duty to serve the general public. Do fire fighters have the right to not protect your home because you are a sinner by their beliefs? Does the first aid responder or doctor have the right to turn you down? You see the stupidity in this. This is only gasoline on the fire to put down Christianity and religion in general. If you are going to be in a public service sector. You need to serve the public. If you want to service just certain people it should not be public it should be a private club. This is stupid and the court has no sense in what they allowed. When people exclude others, making them second class citizens they are not Christian they are thugs and bullies. To discriminate by cherry picking your Bible is not following the religion it has no principle.

Thomas is a complete Supreme Court failure and an Uncle Tom hypocrite and Gorsuch had NO intention of over turning a prior Supreme Court's decision that granted the Equal Protection Clause to gays.

I am just glad it was just a decision on that case and the Supreme Courts did not make an overall decision and written into the Constitution. Gays need to wait to take it to the Supreme Court until they get some more Liberal justices. Some of the Conservative justices are getting old and will not be around much longer.
